Terms of Service

These terms govern use of Azul, provided by Moonshine Distillery Inc., doing business as Azul, both by the companies that record decisions with us and by the people who open a page we serve on their behalf.

Who these terms cover

Moonshine Distillery Inc., doing business as Azul, provides the service these terms cover. Two groups use it, and the terms differ for each.

A customer is a company that records decisions through our API and issues the pages we serve. Their use is governed by these terms together with the written agreement they sign with us. Where the two disagree, the signed agreement controls.

A recipient is a person who opens an explanation, a contest, or a review page because a customer sent them a link. A recipient does not need an account and is not charged. These terms apply to that use.

What the service does

Azul records automated decisions in a verifiable form and serves the pages that follow from that record: an explanation for the person affected, a way to contest the outcome, and a review carried out by a qualified human. Azul does not make the underlying decision. The customer decides, and Azul records what happened and communicates it on the customer's instruction.

Azul is compliance infrastructure. It is not legal advice, and it does not determine whether a particular use of automated decision making is lawful. Customers remain responsible for their own obligations.

Accounts and access

A customer is responsible for its workspace: who is invited, what permissions they hold, and the security of the API keys and links it issues. API keys and page links are credentials. Anyone holding one can do what it permits, so treat them accordingly and revoke any that are exposed.

We may suspend access where an account is used unlawfully, where continued use puts other customers or the service at risk, or where fees are unpaid under a signed agreement.

Acceptable use

You agree not to use Azul to:

  • break the law, or help someone else break it
  • record decisions about a person without the authority to do so
  • send messages to a person who has not consented to receive them
  • interfere with the service, probe it for weaknesses without our written permission, or work around its access controls
  • misrepresent a record, or present material from Azul as something it is not

Email and text messages

Azul sends messages only where they are needed to deliver the service: a verification code, a notice that a decision is ready, or the outcome of a review. We do not send marketing messages to recipients.

Text messages are sent only after the recipient checks the consent box on the page and confirms the number. Message frequency is limited to what the flow requires, and message and data rates may apply depending on the mobile plan. Reply HELP for help or STOP to cancel at any time. Consent to text messages is never required to see a decision, and email verification is always available instead.

Your data

Customers keep ownership of the decision records they create. Recipients keep ownership of anything they submit, such as a contest statement. We use that material to run the service and to keep the record verifiable, and for nothing else. The Privacy Notice explains what we collect, how long we keep it, and the choices available.

Records are designed to be tamper evident. That means we may be unable to alter or remove part of a record without breaking the evidence it exists to provide. Deletion requests are handled as described in the Privacy Notice and in a customer's signed agreement.

Availability and changes

We work to keep Azul available and accurate, but the service is provided as is. We do not warrant that it will be uninterrupted or error free. Any service level commitment lives in a signed agreement, not here.

We may change the service, and we may change these terms. When a change is material we will post the new version with a new effective date, and for customers we will give notice as the signed agreement requires. Continuing to use Azul after a change means the new terms apply.

Liability

To the extent the law allows, Moonshine Distillery Inc., doing business as Azul, is not liable for indirect, incidental, or consequential loss, or for loss of profits, revenue, or data. For customers, our total liability is capped as set out in the signed agreement. For recipients, who pay nothing, our liability is limited to the amount the law requires us to bear.

Nothing in these terms excludes liability that cannot be excluded by law.

Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Disputes will be brought in the state or federal courts located in Delaware, unless a signed agreement says otherwise or the law gives you the right to bring a claim elsewhere.
